Torsion Built Pty Ltd (ABN 87 627 186 850), trading as Torsion Homes and Foundary Co, is committed toprotecting the privacy of personal information we collect and hold. This Privacy Policy explains how wecollect, use, disclose and protect personal information in accordance with the Privacy Act 1988 (Cth) andthe Australian Privacy Principles (APPs), and applies across both of our residential building brands. Furtherinformation on Australian privacy law is available from the Office of the Australian InformationCommissioner (www.oaic.gov.au).

1. COLLECTION OF PERSONAL INFORMATION

The personal information we collect depends on our relationship with you, and may include:

• Clients and prospective clients (Torsion Homes and Foundary Co) - name, contact details, date of birth,address, details of your enquiry (such as the home design, block or location you're interested in, yourbudget or timeframe), financial and lending information relevant to your building contract,identification documents, contract and variation details, correspondence with us, and informationrelevant to site access and inspections.

• Website users and enquirers - name, contact details, enquiry details and other information youprovide through online forms, and technical information such as IP address, browser and device type,and the pages you visit (see “Cookies and website analytics” below).

• Employees and job applicants - contact details, employment and licensing history, qualifications, taxfile number, superannuation and banking details, emergency contact details, and work health andsafety information.

• Subcontractors, suppliers and consultants - business and contact details, licensing and insuranceinformation, banking details, and performance-related information.

• Site neighbours and other third parties - contact details and information relevant to constructionactivities, such as complaints or site access arrangements.

We only collect personal information that is reasonably necessary for our business functions. We do notintentionally collect sensitive information (such as health information) except where necessary, forexample, work health and safety records, or accessibility requirements you volunteer to us and only withconsent or as otherwise permitted by law.

2. HOW WE COLLECT PERSONAL INFORMATION

Wherever practicable, we collect personal information directly from you, for example when you:

• complete an enquiry or contact form on our website

• call, email or message us

• register your interest or subscribe to updates

• book or attend an appointment or display home visit

• interact with our social media pages or online advertising

• sign a building contract, or apply for a job with us

We may also collect personal information from third parties, including referrers, real estate agents andfinanciers; certifiers, inspectors and government or regulatory authorities (e.g. the QBCC, local councils);your legal, financial or other representatives; and referral partners, where you have consented or wouldreasonably expect this. We may also collect information automatically through our websites using cookiesand analytics tools (see “Cookies and website analytics” below).

3. WHY WE COLLECT, HOLD, USE AND DISCLOSE PERSONAL INFORMATION

We collect, hold, use and disclose personal information to:

• respond to your enquiries and provide the information or services you ask for

• guide you through the home building process, and prepare quotes, proposals and contracts

• perform our obligations under a building contract, including project management, scheduling,inspections and certification

• keep you updated about your build, our homes, display homes and offers

• manage our relationships with subcontractors and suppliers

• comply with our legal and regulatory obligations, including under the Queensland Building andConstruction Commission Act 1991, work health and safety legislation, and taxation law

• recruit and manage our employees• improve our websites, products and services

• direct marketing (see below)

• internal administration, including finance, insurance and dispute resolution

By submitting your personal information to us, you consent to us using it in the ways described in thispolicy. If you choose not to provide personal information we've requested, we may not be able to provideyou with the information, products or services you're seeking.

4. MARKETING COMMUNICATIONS

We may send you marketing communications about our homes, display homes, events and offers, undereither the Torsion Homes or Foundary Co brand. You can opt out at any time by using the unsubscribe linkin our emails or by contacting us directly, and we’ll action your request promptly.

5. DISCLOSURE OF PERSONAL INFORMATION

We may share personal information with:

• our team and related entities within the Torsion Built group, across both Torsion Homes and FoundaryCo

• subcontractors, trade partners, consultants and suppliers involved in your build

• building certifiers and inspectors

• financiers, lenders and their representatives, where relevant to your contract

• trusted third-party service providers who help us run our business, including our accounting software(MYOB and Xero), our sales CRM (Rapid Platform), our construction CRM and scheduling platform

(iHub), our marketing CRM (HubSpot), our building design and documentation software(Autodesk/Revit), our document storage and collaboration platform (Microsoft SharePoint), and ourwebsite host (Squarespace)

• government and regulatory bodies, including the QBCC, local councils and other relevant Queenslandauthorities

• our professional advisers, including lawyers, accountants and insurers

• any other party where required or authorised by law, or with your consent

We do not sell your personal information. Where we share information with third parties, we takereasonable steps to ensure they handle it in line with this policy and the Privacy Act.

6. OVERSEAS DISCLOSURE

We use a number of software platforms to run our business, some of which may store or process personalinformation outside Australia:

• MYOB (accounting and financial management) - data is hosted in Australia.

• Xero (accounting and financial management) - data is hosted in the United States.

• Rapid Platform (sales CRM) - data is hosted in Australia.

• iHub (construction CRM and scheduling) - data is hosted in Australia.

• Microsoft SharePoint (document storage and collaboration) - data is hosted in Australia for Microsoft365 tenants provisioned with an Australian billing address, which we expect applies to our tenant.

• Squarespace (website hosting, including enquiry and contact form submissions) - data is hosted in theUnited States.

• HubSpot (marketing CRM) - HubSpot hosts customer data in Australia, the United States, Canada orthe European Union, depending on the data centre assigned to an account.

• Autodesk/Revit (building design and documentation) - where cloud collaboration features are used,project data may be hosted in Australia, the United States, Europe or the United Kingdom, dependingon the region selected for the account.

Where personal information is disclosed to an overseas recipient, we take reasonable steps to ensure it ishandled in a manner consistent with the Australian Privacy Principles, to the extent required by law.

7. COOKIES AND WEBSITE ANALYTICS

Our websites use cookies and similar technologies to help them work, remember your preferences, andunderstand how visitors use the site. We may use analytics and advertising tools such as Google Analyticsand Meta (Facebook) to improve our websites and marketing. You can control or disable cookies throughyour browser settings, though some parts of the site may not work as intended if you do.

8. DATA QUALITY

We take reasonable steps to ensure the personal information we collect, use and disclose is accurate, up todate and complete. Please let us know if your details change.

9. DATA SECURITY

We take reasonable steps to protect personal information from misuse, interference, loss, andunauthorised access, modification or disclosure. This includes secure storage, access controls, and the useof reputable service providers. We keep personal information only for as long as we need it for thepurposes described in this policy, or as required by law, for example, under building industry recordkeeping requirements after which we take reasonable steps to destroy or de-identify it.

If we experience a data breach that is likely to result in serious harm, we will comply with our obligationsunder the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of theAustralian Information Commissioner (OAIC) where required.

10. ACCESSING AND CORRECTING YOUR INFORMATION

You can ask to see the personal information we hold about you, and ask us to correct it if it’s inaccurate,out of date or incomplete, by contacting us using the details below. We will respond within a reasonableperiod. There is generally no charge to request access, although we may charge a reasonable fee to coverthe cost of retrieving and providing information in some circumstances. We may need to verify youridentity before we can help.

There may be circumstances where we are not required to provide access, for example, if it wouldunreasonably impact the privacy of others, or if providing access would be unlawful. If we refuse a requestfor access or correction, we will explain why.
